Dans le cas o\u00f9 l&rsquo;entrepreneur ne r\u00e9pare pas les <em>d\u00e9fauts de construction<\/em>, une plainte peut \u00eatre d\u00e9pos\u00e9e contre lui aupr\u00e8s du registre des constructeurs.<u><\/div><a href=\"#\" class=\"close mfn-close-icon\"><span class=\"icon\">\u2715<\/span><\/a><\/div>\n<\/u><\/strong><\/p>\n<p>La responsabilit\u00e9 du promoteur\/constructeur est divis\u00e9e en deux p\u00e9riodes : la P\u00e9riode de v\u00e9rification (\u00ab\u00a0<em>tkoufat Habedek<\/em>\u00ab\u00a0) et la p\u00e9riode de garantie.<\/p>\n<ul>\n<li><strong>La p\u00e9riode de v\u00e9rification<\/strong> : durant cette p\u00e9riode, le vendeur se doit de r\u00e9parer tous les d\u00e9fauts de construction constat\u00e9s lors de la r\u00e9ception du logement neuf, quelles que soient leur nature et leur importance, sauf s&rsquo;il arrive \u00e0 prouver que ce d\u00e9faut a \u00e9t\u00e9 caus\u00e9 par le propri\u00e9taire de l&rsquo;appartement. Cette p\u00e9riode commence lors de la remise des clefs de l&rsquo;appartement et dure de 1 \u00e0 7 ans (suivant la nature du d\u00e9faut). Cette p\u00e9riode commence \u00e0 la fin de la p\u00e9riode de v\u00e9rification et dure 3 ans.<\/li>\n<\/ul>\n<p>Apr\u00e8s la p\u00e9riode de v\u00e9rification et apr\u00e8s la p\u00e9riode de garantie, la responsabilit\u00e9 de l&rsquo;entrepreneur ne s&rsquo;applique que dans les cas suivants :<\/p>\n<ul>\n<li>Instabilit\u00e9 ou ins\u00e9curit\u00e9 du b\u00e2timent, provenant de l&rsquo;ossature ou des fondations du b\u00e2timent.<\/li>\n<li>Si un dysfonctionnement est apparu et qu&rsquo;il n&rsquo;y avait aucune possibilit\u00e9 raisonnable de le d\u00e9couvrir au cours des premi\u00e8res ann\u00e9es du logement \u00a0ou si l\u2019acheteur de l\u2019appartement avait annonc\u00e9 une non-conformit\u00e9 au vendeur au cours des premi\u00e8res ann\u00e9es suivant la r\u00e9ception de l\u2019appartement et que le d\u00e9faut n\u2019avait pas \u00e9t\u00e9 corrig\u00e9.<\/li>\n<\/ul>\n<p>Dans le cas o\u00f9 le contrat d\u2019acquisition a \u00e9t\u00e9 sign\u00e9 <strong>avant le 6 avril 2011<\/strong>, la r\u00e8glementation en vigueur avant le vote du cinqui\u00e8me amendement de la loi relative aux acquisitions immobili\u00e8res sera alors appliqu\u00e9e.<\/p>\n<p>Toute personne qui ach\u00e8te un nouvel appartement d&rsquo;un entrepreneur, r\u00e9sident en Isra\u00ebl ou r\u00e9sident \u00e9tranger, b\u00e9n\u00e9ficie de ces p\u00e9riodes de garanties \/ de v\u00e9rifications quant aux d\u00e9fauts de construction.<\/p>\n<p>Selon la <a href=\"https:\/\/www.nevo.co.il\/law_html\/law01\/240_004.htm\">loi<\/a>, le propri\u00e9taire est tenu d\u2019informer le promoteur, durant toute la dur\u00e9e de la p\u00e9riode de v\u00e9rification, de chaque d\u00e9faut de construction dont il a connaissance. Le promoteur a ainsi l\u2019obligation d\u2019effectuer ces r\u00e9parations. Les propri\u00e9taires ne doivent pas prouver qu\u2019il s\u2019agit de la responsabilit\u00e9 du promoteur\u00a0; celle-ci est automatique sauf si le promoteur prouve que l\u2019acqu\u00e9reur est responsable.<\/p>\n<p>Si l&rsquo;entrepreneur ne corrige pas les d\u00e9fauts de construction, une plainte peut \u00eatre d\u00e9pos\u00e9e contre lui aupr\u00e8s du registraire des entrepreneurs du minist\u00e8re de la Construction et du Logement.
